We are pleased to announce that our appeals team has secured its second precedent-setting victory before the Federal Circuit Court of Appeals in the past year. Specifically, the Federal Circuit just issued a precedential opinion REVERSING AND REMANDING a district court determination that our client Canatex’s patent was invalid due to a minor error in the claims. Canatex Completions Solutions, Inc. v. Wellmatics, LLC, No. 2024-1466, 2025 WL 3153362, 2025 U.S. App. LEXIS 29576, F.4th (Fed. Cir. 2025). The Federal Circuit acknowledged that the standard for judicially correcting claim terms is “very demanding,” but agreed with us “that it is evident that the claim contains an error and that a relevant artisan would recognize that there is only one correction that is reasonable given the intrinsic evidence.” Id. at *3, 11. The decision has been the subject of extensive discussion, such as IP Law360 (https://lnkd.in/gSxStrHz), IP Watchdog (https://lnkd.in/gkjpn7XV), and Patently-O (https://lnkd.in/gsGfdwNw)
We are delighted for, and grateful to, our client Canatex, who continued to trust us to enforce its patent rights even when the chips were down. We are also honored to have played a part in helping to establish new Federal Circuit precedent for a second time this year. As attorneys, having part in precedent-setting case law is one of the greatest contributions we can make to the law. Precedent provides guidance to the public and helps promote consistency, fairness, and predictability in the law.
We are proud that our appeals team here—David Cabello, Stephen Zinda, and Munira Jesani—made this contribution. And we look forward to continue advocating for Canatex before the district court on remand.
